Phase 3: Design has commenced.
Once a Compulsory Purchase Order (CPO) and accompanying Environmental Impact Statement has been published for this scheme, an Oral Hearing will be held by An Bord Pleanála (ABP). ABP reviews all the submissions, conducts the Oral Hearing and adjudicates on the planning application. If ABP finds in favour of the scheme, and there are no challenges to it, the CPO is confirmed. Notice to Treat is served on affected landowners within 18 months of confirmation of the CPO. It is after Notice to Treat has been served on landowners that landowners can claim for solicitors costs, valuers costs and other professional fees by agreement with the local authority. Landowner costs incurred before the CPO has been confirmed are not recoverable from the local authority.
